TRANSFORMATIONAL TOURS’ BOOKING TERMS & CONDITIONS


TOUR PRICE INCLUDES

  • Hotel Accommodation - 10 nights’ room accommodations are provided at the hotels indicated on this itinerary. Accommodations are per person, based on two persons sharing a twin-bedded room or king room with private bath
  • Flights in India Delhi to Bodhgaya Varanasi to Delhi
  • Tours and Sightseeing - by private, air-conditioned car, as specified in itinerary; all admissions and entrance fees to places visited as per the itinerary.
  • All breakfasts (10), 5 lunches, and 7 dinners (including Welcome and Farewell dinners)
  • Licensed English-speaking guide throughout the Tour
  • Transformational Tours coordinator throughout the Tour
  • Boat ride on River Ganges
  • Private airport transfers and transfers between hotels
  • VIP greeting at the airport in Delhi
  • Taxes - all local taxes and hotel taxes of 21% are included in the cost of the Tour
  • Porterage handling of luggage at all hotels

TOUR PRICE EXCLUDES

  • Gratuities to local guides & drivers. These tips of $200/guest are to be paid on arrival.
  • International Air tickets
  • India visa ($25)
  • Other documentation costs (if any)
  • Travel insurance (mandatory - will provide quotes on request, or buy on your own)
  • Excess baggage charges
  • Beverages, except water, unless noted
  • Laundry or any other item of a personal nature not specifically mentioned herein.
  • Any tour not specifically mentioned in the itinerary
Any increase in entrance fees, tickets and/or domestic airline charges will be passed on as trip price increases, as they are controlled by the governmental and out of our own control.

Please note that this is a courtesy only and you are responsible for your flight management, seat assignments, check-in, transit (including hotels if applicable) and documentation for your flight. Transformational Tours & Retreats takes no responsibility beyond booking your air travel.

DEPOSITS & PAYMENTS

$6,995 per person covers the complete land package as indicated in the itinerary. Main Tour is based on a minimum of 20 guests. A non-refundable deposit of $995 holds your space. Interim payments of $2000 each are due on or before April 23, 2020 and August 07, 2020. If you sign up after an interim payment is due, (space permitting) the current total up to that date is due at time of booking. Final payment of $2,000 is due no later than November 07, 2020. If you sign up after that day, (space permitting) payment is due in full at time of booking. If paying by credit card, please add $244.82 administrative fee to the final total. A payment plan is available but all payments must be received in full by November 07, 2020. Visa, Mastercard, and American Express are gladly accepted. Personal and cashier’s checks are also accepted. Please either pay by credit card through our secure online system or, if you are planning on paying by check or wire transfer, call (888) 600-7541 to make arrangements. Departure taxes, security, and fuel surcharges are subject to change without notice.

CANCELLATION

INITIAL DEPOSIT OF $995 IS NON-REFUNDABLE IN THE CASE OF CANCELLATION. GUESTS CANCELING PRIOR TO APRIL 23, 2020 RECEIVE A FULL REFUND LESS THE INITIAL DEPOSIT. GUESTS CANCELLING PRIOR TO NOVEMBER 07, 2020 RECEIVE A 50% REFUND OF ALL MONIES LESS THE INITIAL DEPOSIT. GUESTS CANCELLING ON OR AFTER NOVEMBER 07, 2020 RECEIVE NO REFUND. WE STRONGLY ENCOURAGE ALL TRAVELERS TO BUY TRIP INSURANCE IN CASE OF CANCELLATION AND ARE HAPPY TO ASSIST WITH THIS PROCESS.

ROOMMATES/SINGLE SUPPLEMENTS

Single rooms are available upon payment of a single room supplement of $1851 per person. Transformational Tours & Retreats will provide roommates wherever reasonably possible, upon request. If no roommate is available when the Tour closes, the guest will be required to pay a single supplement, so guests are strongly encouraged to sign up with their own roommates.

TRAVEL DOCUMENTS

All travelers need a passport valid for at least six months AFTER the date of entering the country (your passport MUST be valid through at least JULY 23, 2021 or you must renew before travel). Please note that this rule is enforced by the Indonesian Government. Holders of United States Passports are NO LONGER required to obtain visas to visit Indonesia.

BAGGAGE

Between North America and Asian destinations, each passenger is allowed two pieces of checked baggage. Please check with your airline for specifics on the size and weight of your allowed baggage.

AFFILIATION

Transformational Tours & Retreats is registered with the State of Florida as a Seller of Travel, Registration No. TI64162, is a dba of Halle Eavelyn Enterprises, LLC, and a member of the Gifted Travel Network. Gifted Travel Network, Inc. is registered with the State of Florida as a Seller of Travel, Registration No. ST39093, and with the California Seller of Travel Program, Registration No. 2113317-40.

RESPONSIBILITY

Transformational Tours & Retreats has made arrangements for the tour services described in your itinerary and final invoice. Hotels, airlines, and other suppliers providing tour services are independent contractors and are not the agents, employees or staff of, or joint venturers with Transformational Tours & Retreats. All certificates and other travel documents for tour services issued by us or our booking agent, Ekno Travels Aus, or by Gifted Travel Network, are subject to the terms and conditions specified by the supplier and the laws of the countries is which the services are supplied. By agreeing to utilize the services of Transformational Tours & Retreats, the Participant agrees that Transformational Tours & Retreats, Ekno Travels Aus, Gifted Travel Network, Oneness For All, LLC (“Oneness”), Howard Caesar, and any of their affiliates, employees or agents (collectively, the “Released Parties”), shall not be liable for any delay, inconvenience, loss of employment, upset, disappointment, distress or frustration, whether physical or mental, resulting from the act or omission of the Released Parties or shall be liable for any damage, loss, claim, cost or expense arising out of personal injury, accident, or death, loss, damage or delay of baggage or other property, resulting from: 1. the act or omission on the part of any person including but not limited to the Released Parties 2. acts of God, sickness, theft, labor disputes, mechanical break-down, government actions, weather, or any cause beyond the control of the Released Parties. No person, other than a representative of Transformational Tours & Retreats or Ekno Travels Aus, Oneness, or Howard Caesar, authorized by a document in writing, may vary, add or waive any term or condition in this brochure, including any term or condition set forth in the preceding provisions. Written notice of any claim against any Released Party must be received no later than fourteen (14) days after the date that services were provided to a Participant making the claim or else such claim shall be entirely barred, and fully released and waived. Although every effort will be made to deliver the Tour exactly as in the itinerary, all terms and conditions, including fares, schedules, locations and rates are subject to change without notice. Quality and class will remain substantially the same.

TRAVEL INSURANCE

Transformational Tours & Retreats offers travel insurance which gives you unparalleled access to Allianz’ travel insurance options. If you need help purchasing insurance, please call us at (888) 600-7541. If you do NOT want travel insurance, you will also need to sign a waiver indicating this. Please note: If you want “cancel for any reason” insurance, you MUST purchase it within 30 days of your initial deposit.

DOCUMENTS

Prior to starting the Tour, Participant shall take all actions and obtain all passports, permits, visas and other documents and preparations necessary for Participant to travel to and from all destinations associated with the Tour in compliance with all applicable laws. Participant is responsible for any applicable government entry/exit fees associated with the Tour. The Released Parties take no responsibility for cancellation of the Tour in the event that Participant is not allowed to fly, enter a country or continue the Tour. If Participant is unable to travel due to not being able to obtain (or not having) the appropriate passports, permits, visas and other required documents and preparations, we reserve the right to retain the cost of the Tour.

COMPLIANCE WITH LAWS AND INSTRUCTIONS

Participant shall follow all applicable laws, requirements and regulations in the countries and areas associated with the Tour. Participant shall not use any recreational drugs or chemical substances at any time during the Tour even if use of those drugs or substances may be lawful in the country where Participant resides or the Tour occurs. Participant shall promptly accept all decisions and follow all instructions of the Tour leaders who shall have absolute discretion and authority to direct the Tour. If Participant’s physical condition or behavior is such as to affect the well-being or safety of Participant or other members of the Tour group, Participant may be asked to leave the Tour without recourse to refund or other compensation.

FLEXIBILITY

Participant agrees that the nature of the Tour requires a degree of flexibility and that the contents and timings of the Tour (including the arrival time at the Tour’s destinations, changes in route or methods of transport) may be materially and consequentially affected as a result of force majeure, weather, local political conditions, safety factors, natural disasters (including landslides, quakes, and severe flooding), strikes, entry or border difficulties, mechanical breakdowns, flight cancellations, disease, sickness or other unforeseen circumstances. Participant agrees to be flexible and acknowledges that the Released Parties will not be responsible for delays and alterations in the schedule, or for possible expenses incurred as a result of any delays or alterations arising from any such circumstances.

CAPACITY

Participant represents and warrants that Participant has sufficient physical and mental health and financial capability to travel to and from, and participate in, the Tour in a healthy and safe manner without any adverse consequences to Participant, and further accepts all risks associated with the same. Participant should only travel to and from, and participate in, the Tour if doing so will not adversely impact the physical and mental health and financial condition of Participant. Participant shall be legally responsible for his or her own physical and mental health, safety, behavior and financial condition in connection with traveling to and from, and participating in, the Tour. Some aspects of the Tour may involve physical activity of sitting, standing, moving, walking, and climbing over long periods of time and uneven terrain, as well as mental, emotional, and psychological efforts.

DISABILITIES

We will do our reasonable best to provide transport, lodging and other travel arrangements that accommodate various disabilities. Particpant understands that the countries and areas associated with the Tour may not have accommodations for certain disabilities similar to those in the country where Participant resides, or at all. Any Participant who needs accommodation of certain disabilities should contact us prior to booking the Tour to discuss the availability of those accommodations and whether the Tour is right for the Participant. The Released Parties are not responsible for the unavailability of any accommodations for disabilities.

MEDICAL

Should Participant require emergency or other medical treatment as a result of accident, illness or other conditions arising in connection with the Tour, Participant hereby consents to such treatment and the Released Parties shall not have any liability for the same. Participant shall be financially responsible for any medical, legal and other charges that may be incurred as a result of such emergency and/or other medical treatment. Participant shall promptly notify the Tour guides orally and in writing if Participant is at any time or manner directly or indirectly injured or becomes ill in connection with the Tour or if Participant has medical conditions about which emergency or other medical personnel should be informed; however, Participant understands that the Tour operator and/or Released Parties are not legally obligated to act on that information in any way or to provide any medical service or accommodation whatsoever to Participant. The Tour operator and/or Released Parties do not provide any physical or mental health, suicide or other similar advice or intervention and Participant should contact Participant’s own healthcare providers on such matters. Participant agrees that if Participant has any medical, mental health or psychological conditions that may hamper Participant from fully, safely and healthfully participating in the Tour, that Participant shall notify the Tour operator in writing of those conditions before the Tour and the Tour operator retains the right to ask that Participant not participate in portions, or the entirety, of the Tour. We reserve the right at any time to require that Participant produce a doctor’s certificate certifying that Participant is fit to participate in the Tour.

FOOD

We do not directly provide any food or beverages for the Tour, and rely upon independent contractors to provide such food and beverages. We count on contractors to make every attempt to identify ingredients that may cause allergic reactions for those with food allergies. Because of the number of meals served and the number of items used, along with food product changes from food vendors, it cannot be guaranteed that every allergen in the food and beverages served will be identified and labeled. There is also a possibility that manufacturers of the foods and beverages could change the formulation of those items at any time, without notice. Participants concerned with food and beverage allergies must make themselves aware of this risk. The Released Parties shall not assume any liability for adverse reactions to foods or beverages consumed, or items Participant may come in contact with, while eating or drinking any substances in connection with the Tour. Participants with food allergies who may need to use epi-pens or similar devices or other medications should carry their own. Tour staff do not carry epi-pens or similar devices or other medications and are not trained to administer epi-pens or similar devices or other medications and cannot provide or administer them. Participants with food allergies are encouraged to contact their physicians for additional information and/or support.

NO PROFESSIONAL ADVICE.

While it is hoped that the Tour will benefit Participant, Participant understands that the Tour is not intended to offer any professional, personal, mental, psychological, medical, health, suicide prevention, financial, accounting, investment, tax, legal or other professional advice. The Tour does not replace or substitute for the services of trained professionals in any field, including, but not limited to, mental, psychological, medical, health, financial, accounting, investment, tax, legal or other professional fields. Participant acknowledges that if Participant is under the care of medical, psychological or other professionals that the Tour is not intended to conflict with the advice of such medical, psychological or other professionals and that Participant will not use any Tour information, materials or experiences in any manner that conflicts with the advice of Participant’s medical, psychological or other professionals. Nothing associated with the Tour shall constitute any kind of representation, warranty, promise or guaranty of profitability, earnings, investments, health, outcomes or successes. Any forward-looking statements associated with the Tour are simply statements of possibilities, not representations, warranties, promises or guaranties.

AUDIO/VISUAL RELEASE.

Participant understands that portions of the Tour may be recorded or captured in videos, photographs, audio recordings and/or other media (the “Recordings”). Participant agrees that Oneness and/or Transformational Tours & Retreats owns all right, title and interest in the Recordings and has the right and permission to use the Recordings even if they include Participant’s name, likeness, voice, biographical details, testimonial, or photograph for marketing, advertising or any other purpose in any media or format, online and/or offline, now or hereafter without further notice or compensation to Participant for the use of such Recordings. If Participant does not want to be captured in any such Recordings, Participant should make special arrangements with Oneness and/or Transformational Tours & Retreats on such matters. While Oneness and/or Transformational Tours & Retreats will make good faith efforts to honor such privacy requests, the Released Parties shall not have any liability in connection with the same.

NO NEGATIVE STATEMENTS OR ACTIONS.

Participant shall not at any time directly or indirectly take any action and/or make, publish, file or record any oral or written statements that would likely have a negative or injurious impact upon, or that is derogatory, defamatory, libelous or slanderous to, any of the Released Parties.

INCIDENTAL CHARGES

Our total price includes all taxes and fees applicable to airfare, hotel accommodation, car rentals and activities included in the Tour, unless stated otherwise in the ticket information. Additional fuel surcharges, security, baggage, seat reservation, hotel incidentals, and other applicable service charges may apply which will be charged by the relevant travel supplier. Participant is solely responsible for any such additional charges due to the travel supplier.

ADDITIONAL TERMS RE. CANCELLATION.

Any cancellations must be in writing and be made by the Participant who signed this proposal. After the departure date of the Tour, no refund for any unused portion of the Tour or services to be provided will be given. If Participant makes any alterations to, or departs from, any portion of part of the Tour, such alteration or departure will be entirely at Participant’s expense and liability and Participant shall communicate in writing with us about the reason for leaving the Tour. We reserve the right to cancel the Tour if necessary, if forced to do so by virtue of unforeseen circumstances or other force majeure conditions outside of our control, such as flight cancellations, civil or political unrest, health concerns, or possibly on group tours where minimum numbers have not been reached. If we must cancel the Tour due to such force majeure conditions outside of our control, we will only reimburse funds we can recover, less the Initial Deposit. It is up to Participant to have suitable travel insurance to cover any additional losses.

RISKS AND HAZARDS

We will do our reasonable best to arrange for interesting and safe travel, transport and accommodations. Participant understands that the Tour involves potential risks and hazards including injury, loss or damage to property, discomfort and inconvenience. Participant is responsible to be aware of any advice or warnings respecting the safety and conditions of the countries and areas in which Participant will travel in connection with the Tour. We will arrange local accommodations and transport including hotels, restaurants, buses, vehicles, trains, river craft or aircraft operated by local independent contractors. Participant understands that the safety and comfort standards in the areas associated with the Tour may not be the same as those in the country where Participant resides and things like safety belts, smoke detectors, fire escapes and the like may not be available or required. The Released Parties shall not be liable for failure of travel service suppliers, including but not limited to airlines, hotels, cruise lines, railroads, car rental agencies, tour operators and consolidators to perform the services offered by such suppliers. In the event that a supplier defaults prior to providing the service to Participant for which payment has been made, the sole recourse for refund shall be with the defaulting supplier, from insurance covering such defaults if any or from other responsible third party other than the Released Parties.

LIMITATIONS ON LIABILITY.

Participant hereby irrevocably, unconditionally and forever assumes liability for, releases, waives, defends, covenants not to sue, holds harmless and indemnifies the Released Parties from and against any and all liabilities, actions, claims, debts, liens, demands, obligations, damages, losses, accidents, illnesses, injuries, deaths, delays, inconveniences, losses of employment or income, upsets, disappointments, distresses or frustrations (whether physical or mental), acts of God, sicknesses, thefts, labor disputes, mechanical break-downs, government actions, and/or expenses, including attorneys' fees and costs, and/or other claims incurred at any time directly or indirectly, entirely or in part by Participant in connection with the Tour and/or the Released Parties. The Released Parties shall not be liable for any delay or failure in performance under the Documents, resulting directly or indirectly from acts of God, or any causes beyond the reasonable control of the Released Parties. The prevailing party shall be entitled to be reimbursed by the non-prevailing party for all costs, including collection, court and attorneys’ fees and expenses, incurred by the prevailing party in any action or defense involving the Tour.

ACKNOWLEDGMENT & AGREEMENT

By signing this Agreement, I agree to accept and abide by all the terms and conditions outlined above. I acknowledge being fully informed about the details of this Tour and of the cancellation policy.
